Land law is state law. These rules are maintained on the Uttarakhand page and apply to every district within it.
Nainital — land purchase legal rules (Bhu Kanoon 2025)
⚠ Uttarakhand is India's most restricted state for outside land buyers. The Bhu Kanoon Act, 2025 (amending the UP Zamindari Abolition & Land Reforms Act, 1950) severely limits outsider land purchase. Eligibility varies by district and land type — read every rule below before browsing listings.
Who can buy agricultural land? Only residents of Uttarakhand classified as agriculturists can freely buy agricultural and horticultural land. Non-residents are barred from purchasing agricultural land in 11 of 13 districts without state government permission, which is rarely granted.
Haridwar & Udham Singh Nagar — a discretionary path, not an exemption: non-domiciled buyers can apply for agricultural-land approval in these two districts only. This is a case-by-case State Revenue Ministry review requiring proof of genuine farming or agro-business purpose — it takes 3–9 months and is frequently refused for purchases seen as speculative. It is not an automatic entitlement, and it does not exist in any other district.
Non-agricultural / residential land: non-residents may buy up to 250 sq metres of residential land in non-municipal areas for constructing a house. Larger plots require state government approval.
Section 143 — land use conversion: agricultural land must be converted with Section 143 permission from the SDM/DM before it is used for residential or commercial purposes. Ask for the parcel's Section 143 status directly — do not assume a listing is conversion-ready.
NRI & OCI buyers: FEMA 1999 prohibits NRIs and OCIs from purchasing agricultural land, plantation property and farmhouse land anywhere in India, Uttarakhand included. NRIs may purchase a converted residential plot within the 250 sq m ceiling.

Nainital — district-specific notes
The full Uttarakhand legal framework above (inherited from the state record) applies to Nainital in full.
⚠ Like Dehradun, Nainital is not one of the two districts (Haridwar, Udham Singh Nagar) where non-domiciled buyers can apply for discretionary agricultural-land approval. Agricultural land here under Section 143 UZALR is restricted to buyers domiciled in Uttarakhand. Non-agricultural purchase (up to 250 sq m residential, 500 sq m commercial statewide) remains the reliable route.
A separate, documented concern in the Ramnagar/Jim Corbett belt specifically: reported cases of illegal structures (including religious shrines) built on Forest Department land inside the park landscape over the past decade. This is unrelated to standard purchase eligibility but underscores the importance of confirming a parcel's actual jurisdiction and legal status before any transaction near the park boundary.

District overview
Nainital — lakes, hills, and India's original tiger reserve
Nainital district spans genuine Kumaon hill-station territory — the lake towns of Nainital and Naukuchiatal, the Bhowali orchard belt — down to the Terai-edge plains around Ramnagar, home to Jim Corbett National Park. This range of geography means Nainital covers two genuinely different buyer theses within one district: hill-station lifestyle land in the lakes area, and eco-tourism/resort land around Corbett.
Real listing data for Nainital district plots shows figures like ₹4,050 per sq yard for a 150 sq yard parcel — consistent with a modest, accessible entry point relative to Dehradun's much higher periphery pricing.
The Corbett belt specifically — see the dedicated Jim Corbett page — has its own distinct eco-tourism economy, hospitality brand presence, and eco-sensitive-zone considerations that don't apply to the Nainital lakes area proper.

Why investors look at Nainital
Two distinct theses within one district.
Genuine hill-lake scenery, not marketing language
Nainital and Naukuchiatal are real, established lake destinations with decades of tourism history.
A distinct eco-tourism thesis via Corbett
India's first tiger reserve gives the Ramnagar belt a wildlife-tourism economy independent of the lakes area entirely.
Confirm domicile status directly for agricultural land — this district is not part of the discretionary-approval exception.
